OkayDive Diving & Snorkeling Club LLC(“COMPANY”) maintains the https://www.okaydive.com/ Website (“https://www.okaydive.com/”). The following are the terms of use that govern use of the Site (“Terms of Use”). By using the Site, you expressly agree to be bound by these Terms of Use and the https://www.okaydive.com/ privacy policy and to follow these Terms of Use and all applicable laws and regulations governing use of the Site. COMPANY reserves the right to change these Terms of Use at any time, effective immediately upon posting on the Site. Please check this page of the Site periodically. We will note when there are updates to the Terms of Use at the bottom of the Terms of Use. If you violate these Terms of Use, COMPANY may terminate your use of the Site, bar you from future use of the Site, and/or take appropriate legal action against you.
LIMITED LICENSE. You are granted a limited, non-exclusive, revocable and non-transferable license to utilize and access the Site pursuant to the requirements and restrictions of these Terms of Use. 2.1. Course Availability: The availability of scuba diving courses offered on the Website is subject to change without notice.
2.2. Booking Process: To book a course through the Website, you must provide accurate and complete information during the booking process.
2.3. Booking Confirmation: Your course booking is not confirmed until you receive a booking confirmation email from Okay Dive.
2.4. Booking Modifications: Any modifications to your booking must be made in accordance with the booking modification policy provided on the Website.
3.1. Course Fees: The fees for scuba diving courses are listed on the Website and are subject to change without notice.
3.2. Payment Methods: Okay Dive accepts payment through various online payment methods, as specified on the Website.
3.3. Payment Confirmation: Your course booking is confirmed upon successful payment. A payment confirmation email will be sent to you.
3.4. Visa or MasterCard debit and credit cards in AED will be accepted for payment
3.5. Customers using the website who are minors or under the age of 18 shall not register as users of the website and shall not transact on or use the website
3.6. Cardholder must retain a copy of transaction records and Merchant policies and rules
3.7. The user is responsible for maintaining the confidentiality of his account
4.1. Cancellation by Okay Dive: Okay Dive reserves the right to cancel or reschedule a course due to unforeseen circumstances. In such cases, Okay Dive will make reasonable efforts to accommodate you with an alternative course date or provide a refund, as applicable.
4.2. Cancellation by You: If you need to cancel or reschedule your course booking, please get in touch with the contacts mentioned below the website. Cancellation is 48 hours prior to the scheduled dive trip. Failure to cancel within this period will still charge you for the full amount of the booked diving trip.
4.3. Refund Policy: Refunds will be made onto the original mode of payment and will be processed within 15 days depends on the issuing bank of the credit card.
5.1. Website Content: All content on the Website, including text, images, videos, and logos, is the intellectual property of Okay Dive and is protected by copyright laws. You may not use or reproduce this content without express permission from Okay Dive.
6.1. Your use of the Website is also governed by our Privacy Policy, which can be found on the Website.
7.1. Okay Dive shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Website or participation in scuba diving courses, except in cases of gross negligence or willful misconduct.
8.1. Okay Dive reserves the right to modify these Terms and Conditions at any time. It is your responsibility to review these terms periodically for changes.
9.1. These Terms and Conditions are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of the United Arab Emirates.
You understand and agree that in COMPANY’s sole discretion, and without prior notice, COMPANY may terminate your access to the Site, or exercise any other remedy available and remove any unauthorized user information, if COMPANY believes that the information you provide has violated or is inconsistent with these Terms of Use, or violates the rights of COMPANY, or any third party, or violates the law. You agree that monetary damages may not provide a sufficient remedy to COMPANY for violations of these Terms of Use and you consent to injunctive or other equitable relief for such violations. COMPANY may release user information about you if required by law or subpoena.
You agree to indemnify and hold COMPANY, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of or relating to your use of the Site, including also your use of the Site to provide a link to another site or to upload content or other information to the Site, or your breach of the Terms of Use.
By providing materials to COMPANY, including by submitting or uploading content or materials for use on the Site you represent and warrant that you or the owner of all rights to such content or materials has expressly granted COMPANY an irrevocable world-wide right in all languages and in perpetuity to use and exploit all or any part of the content and materials provided by you. COMPANY may publish and distribute any such submitted content or materials at its sole discretion by any method now existing or later developed. You agree that you shall waive all claims and have no recourse against COMPANY for any alleged or actual infringement or misappropriation of any proprietary rights in any communication, content or material submitted to COMPANY. Any communication or materials you send to COMPANY will be treated as non- confidential and non-proprietary and may be disseminated or used by COMPANY for any purpose, including, but not limited to, developing, creating, manufacturing or marketing products or services.
The Site may contain advertisements and/or sponsorships. The advertisers and/or sponsors that provide these advertisements and sponsorships are solely responsible for insuring that the materials submitted for inclusion on the Site are accurate and comply with all applicable laws. COMPANY is not responsible for the acts or omissions of any advertiser or sponsor.
If any provision of the Terms of Use is held to be invalid, void or unenforceable, the remaining provisions shall nevertheless continue in full force and effect.
15.1. All exchange orders, receipts, contracts, and tickets issued by the Okay Dive are subject to applicable tariffs, terms, and conditions under which the accommodation, transportation, and other services whatsoever are provided by the hotels, transport companies, airlines, railroad lines, steamship lines, owners, or contractors concerned. By acceptance of such exchange orders, receipts, contracts, and tickets, the tour participant is deemed to have agreed to the applicable tariffs, terms, and conditions.
15.2. Every person participating in any tour/holiday organized by Okay Dive does so at his own risk with respect to loss or damage to property or injury to a person, except where such loss, damage, or injury was caused by the negligence or willful misconduct of Okay Dive, its employees, or agents. The participant accepts full responsibility for damages, losses, and expenses due to delay, sickness, weather, strikes, quarantine, or acts of God. The leaders/guides or other employees or agents of Okay Dive are authorized to commit to any liability whatsoever, and Okay Dive will not be bound by any statement or representation unless in writing and signed by a management executive of Okay Dive. Okay Dive will not be held responsible for any loss, damage, cost, expense, or inconvenience caused by the suppliers or appointed agents. In no case shall Okay Dive or their employees or agents be liable for any causes outside their reasonable control or from any act or omission of the suppliers or appointed agents.
15.3. Prices: Prices are subjected to revision without notice in the event of unforeseen circumstances like currency fluctuations.
15.4. Dive Cancellation: Okay Dive reserves the right to cancel any dive for any reason whatsoever. Should this happen, the customer can reschedule without any further obligations or liability on the part of the Company.
15.5. Right to Effect Changes: Okay Dive reserves the right to alter any route, itinerary without prior notice to you if it shall in its reasonable discretion think fit and necessary or in the case of force majeure.
15.6. Right to Decline Acceptance: Okay Dive also has the right to decline acceptance of any diver if it appears that the diver is likely to endanger the health or safety, impair the comfort and enjoyment of others.
15.7. Complaints / Claims: Any complaints / claims have to be made in writing to Okay Dive. This agreement is governed by the laws of the United Arab Emirates, and you agree to submit to the exclusive jurisdiction of the courts of the United Arab Emirates.
